2. This Privacy Policy (Policy) is the official Policy of ‘Drizzl’d Franchising Australia’ and all its subsidiaries and associated companies and/or organisations. This policy applies to all personal information retained by ‘Drizzl’d Franchising Australia’, including via www.drizzld.com.au, any and all related intranet or websites, any current or future ‘Drizzl’d Franchising Australia’ applications and platforms (including those on third party social media sites).

CHANGES TO THIS POLICY

26.  ‘Drizzl’d Franchising Australia may be required to change and update this Policy from time to time. This Policy will remain available on ‘Drizzl’d Franchising Australia’ website. Users are encouraged to review the Policy to remain informed of any updates.

27.  By consenting to this policy, users are also consenting to reasonable future changes to this policy and remaining updated per clause 26.



CHANGE IN OWNERSHIP OF ‘DRIZZL’D FRANCHISING AUSTRALIA’

28. Should ‘Drizzl’d Franchising Australia’ merge or be acquired by another company either entirely or partially, user personal information may be disclosed to potential stakeholders for the sole purpose of assessment of current company standing. Upon change of ownership, this information may be transferred to the new entity and/or holding management team. It is expected user personal information will be bound by this Policy and any later versions of the same.

29. As a user, by way of either express or implied consent, you completely accept and consent to the terms stipulated within this Privacy Policy.



OFFERS AND COMPETITIONS

‘The Ballers Club’ Loyalty Program

By participating in this program, members agree to the following terms and conditions:

  1. Eligibility: Participation in the loyalty program is open to all customers who register online through our designated registration portal.

  2. Registration Process: Customers must provide accurate and complete information during the registration process. Any changes to personal details must be promptly updated.

  3. Introduction Offer: The $10 promotional introductory offer is valid only for orders exceeding $20.00. This offer can be redeemed exclusively in-store at the time of the customer's sign-up. This offer is not redeemable at any future date.

  4. Non-Transferable: Membership and its benefits are personal to the member and cannot be transferred or assigned to any other person.

  5. Compliance: Members must comply with these terms and conditions and any other instructions provided by the program administrators.

  6. Termination by Member: Members may terminate their participation in the loyalty program at any time by contacting our customer service on hello@drizzld.com.au using the email that is registered in our loyalty program.

  7. Termination by Company: We reserve the right to terminate any membership for any reason, including but not limited to violations of these terms and conditions.

  8. Program Changes: We reserve the right to modify, suspend, or terminate the loyalty program or these terms and conditions at any time without prior notice. Members will be informed of any significant changes through their registered contact details.

  9. No Liability: The company shall not be liable for any damages, losses, or expenses arising from or in connection with the loyalty program, including but not limited to the availability of promotions or the failure to notify members of benefits.

‘Snap & Tag’

Offer can only be redeemed in-store only at participating ‘Drizzl’d’ outlets.

  1. Offer can only be redeemed with purchases greater than the value of $20.00AUD prior to discount.

  2. Offer only applicable to images uploaded to Instagram where @drizzld_au is tagged. 

  3. Each customer is only eligible for this offer once.

  4. Instagram profiles must be on ‘public’.

  5. Offer can only be redeemed up to one month after the upload date. After one month, the offer is automatically deemed as ‘expired’ unless approved for redemption by the Drizzl’d store manager on the shift.

  6. By showing this offer to ‘Drizzl’d’ staff, you consent to staff physically visualizing on your phone/mobile device that this offer is eligible to be redeemed.  

  7. Offer cannot be exchanged for cash or used in conjunction with any other offer.



‘Spin to Win’

Offer can only be redeemed in-store only at participating ‘Drizzl’d’ outlets.

  1. Offer can only be redeemed with purchases greater than the value of $9.90AUD unless otherwise stipulated.

  2. Minimum purchase value of offer is not applicable for ‘Date Night on Drizzl’d’

  3. Each customer is only eligible for one spin only.

  4. By showing this offer to ‘Drizzl’d’ staff, you consent to staff physically visualizing on your phone/mobile device that this offer is eligible to be redeemed. 

  5. Offer cannot be exchanged for cash or used in conjunction with any other offer.



‘Secret Menu’

Offer can only be redeemed in-store only at participating ‘Drizzl’d’ outlets.

  1. Access to the secret menu can only be redeemed if you hold the links used in the ‘Messenger’ platform or promotional artwork sent to you via email.

  2. By showing this offer to ‘Drizzl’d’ staff, you consent to staff physically visualising on your phone/mobile device that this offer is eligible to be redeemed. 

  3. Offer cannot be exchanged for cash or used in conjunction with any other offer.

‘Gift Cards’

Offer can only be redeemed in-store only at participating ‘Drizzl’d’ outlets.

  1. Digital gift cards must be sighted by Drizzl’d staff.

  2. Drizzl’d staff must be shown the unique gift card serial number.

  3. Offer cannot be exchanged for cash or used in conjunction with any other offer.

‘Promotional Giveaways’

Offers can only be redeemed in-store only at participating ‘Drizzl’d’ outlets unless otherwise stated during the campaign.

  1. Giveaway prizes are subject to in-store availability and may change without notice.

  2. If the giveaway includes a ‘cash giveaway’, the cash will be given directly to the prize winner (the recipient).

  3. If the giveaway includes a ‘cash giveaway’, ‘Drizzl’d Franchising Australia’ will need to be provided with identification and proof of age by the recipient.

  4. If the recipient fails to provide adequate identification and proof of age to ‘Drizzl’d Franchising Australia’, the recipient automatically forfeits the giveaway.

  5. If the recipient is determined to be under the age of 18, the recipients legal guardian must accept the prize and give a written statement via email acknowledging that they are the recipients legal guardian. Furthermore, this statement must outline that they consent to receive the prize on behalf of the recipient.

  6. In the case of Point 5 under ‘Promotional Giveaways’, it is the sole responsibility of the legal guardian to distribute the prize to the recipient. ‘Drizzl’d Franchising Australia’ is not liable if the recipient does not receive the prize from their legal guardian.

  7. When ‘Promotional Giveaways’ are in collaboration with another legal entity, information given will be shared between ‘Drizzl’d Franchising Australia’ and the other legal entity involved in the ‘Promotional Giveaway’ and is subject to the Terms and Conditions of ‘Drizzl’d Franchising Australia’.

  8. If the recipient and/or recipients legal guardian fails to comply with the Terms and Conditions of ‘Drizzl’d Franchising Australia’, ‘Drizzl’d Franchising Australia reserves the right to redraw, resubmit, withhold or cancel the promotional giveaway.

‘Make It A Pack’

Offers can only be redeemed in-store only at participating ‘Drizzl’d’ outlets unless otherwise stated during the campaign.

  1. Items are subject to in-store availability and may change without notice.

  2. ‘Make It A Pack’ promotion includes one (1) cup of gelato of any flavour of your choice AND one (1) cold, ‘canned’ or ‘bottled drink’ within the current Drizzl’d range of your choice.

  3. ‘Make It A Pack’ promotion can only be purchased with any purchase of ‘Hot Ball Doughnuts’ or Churros only.

  4. Not to be used with any other offer.

‘Other discount promotions’

Offers can only be redeemed in-store only at participating ‘Drizzl’d’ outlets unless otherwise stated.

  1. Customers must identify to staff they are claiming the promotion.

  2. Offer cannot be exchanged for cash or used in conjunction with any other offer.
